Conflict of Interest

GENERAL

DEPENDING ON YOUR STATE/PROVINCE/COUNTRY, YOU MAY HAVE SPECIFIC LEGISLATION REGARDING THIS ISSUE.  YOU COULD INCLUDE THIS INFORMATION IN THIS SECTION.

Employees are required to report their continuing outside employment to their immediate supervisor.  Employees must obtain approval by the appropriate Vice President prior to the outside employment.

POLICY

An employee of Employer ABC may not engage in any kind of outside employment if the outside employment:

·         Represents a conflict of interest;

·         Occurs at a time when the individual is expected to perform his/her assigned duties;

·         Reduces the individual's ability to perform his/her primary work obligation to ABC.

These guidelines do not apply to outside employment undertaken by an employee during a leave or vacation period except that no employee may engage at any time in outside employment that represents a conflict of interest.

DEFINITION- REGULAR OUTSIDE EMPLOYMENT

Each employee is responsible for determining what constitutes regular outside employment in a manner consistent with these guidelines.  The following examples of regular outside employment are for illustration purposes and are not meant to be an exhaustive listing of such activities.

·         A professional practice.

·         A consultant to a corporation or private enterprise for a stated period of time or for an indeterminate period even unrelated to a staff member's professional interest.

PROCEDURE FOR REQUESTING PERMISSION FOR OUTSIDE EMPLOYMENT MANAGERS

A request must be completed by the employee and submitted to the immediate supervisor.  The supervisor will forward it to the appropriate Vice President.  The request must reach the Vice President prior to the employee's accepting or beginning any continuing or regular outside employment.

The Vice President and CEO will review the request and a decision transmitted to the applicant within  week, with a copy forwarded to the immediate supervisor.  Employees conducting outside employment shall complete an annual status report with their immediate supervisor each December each year during they intend to continue the outside employment.  Supervisors will contact employees each December concerning the completion of the reporting forms.
