Drug-Free Workplace

POLICY

The unlawful manufacture, distribution, possession or use of controlled substances is prohibited in and on any property owned or controlled by ABC.

Any employee violating this policy is subject to disciplinary action up to and including termination.

Under Federal law, an employee MUST notify the Vice-President of Human Resources of any criminal drug statute conviction for a violation occurring in the workplace no later than five days after such conviction.

DEFINITIONS

·         Conviction: A finding of guilt (including a plea) or imposition of sentence, or both, by any judicial body that determines violations of Federal or State criminal drug statutes.

·         Criminal drug statute: Any criminal statute involving manufacture, distribution, possession, or use of a controlled substance.

·         Controlled substance: A controlled substance defined in schedules I through V of section 202 of the Controlled Substance Act (21 U.S.C. 812).  Possession of a controlled substance due to a valid prescription or other use allowed by law is permitted.
