PURPOSE: To establish a policy to provide a work place that is drug-free and in compliance with the Anti-Drug Abuse Act of 1988.

POLICY: It is the policy of Employer ABC that the unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance is prohibited in the work place.

3.  Response to Conviction

1.     Drug Awareness  informs employees about:

a.     The dangers of drug abuse in the work place;

b.    ABC’s drug-free workplace policy;

c.     Available drug counseling, rehabilitation, and employee assistance programs; and

d.    The penalties for drug abuse violations.

2.     Conditions of Employment for employees:

a.     Abide by the policy.

b.    Notify the Director of Human Resources of any criminal drug conviction no later than five (5) days after such conviction.

3.     Response to Conviction

ABC will within thirty (30) days from receiving notice from an employee of a conviction as described in 2.b.  above:

a.     Take action against the employee up to and including termination; or

b.    Require the employee to successfully participate in a state or federal drug rehabilitation program.
