Leaves of Absence Without Pay

POLICY

A leave without pay shall be granted in writing by the supervisor.  An employee on leave for reasons other than a reduction-in-force are active employees of ABC and will return to his/her original position or a comparable position within the same pay grade and salary.  When an employee returns to work, the leave period shall not constitute a break in continuous or creditable service for the purposes of eligibility for sick leave, annual leave, general pay adjustments, and other benefits and privileges.

PROCEDURE

Temporary Medical Disability

An employee who has used all his/her available sick leave shall, upon request, be granted a leave of absence without pay until the end of the temporary medical disability.  Temporary Medical Disability Leave is contingent on supporting written medical documentation from licensed medical practitioner.

·         All accrued sick leave time must be expended before the beginning of a medical disability leave.  Employees can use accrued annual leave before commencing a medical leave.

·         An on a leave will be notified by the supervisor in writing as to the beginning of the leave and the position to which the employee will return.

·         The supervisor will notify the employee in writing of his or her reappointment.  The effective date of reappointment will be no later than  weeks from the date of receipt of a physician's certificate that the employee is able to resume normal duties.

·         Requests for an extension of leave beyond six months require supervisor approval.  All accrued annual leave will be exhausted prior to the beginning of an extended medical leave. Extensions extend for six months at a time.  At the end of an extended leave, ABC will endeavor to place the employee in a comparable position but cannot guarantee re-employment in the event of an extension.

Other Leave Without Pay

·         A leave of absence without pay may be granted for individual reasons with the approval of the supervisor.  The leave will not exceed six months.

·         In exceptional cases, a leave can be 12 months with the approval of the supervisor.  All accrued annual leave will be exhausted prior to the beginning of the leave.  At the end of the leave, ABC will endeavor to place the employee in a comparable position but cannot guarantee employment at the expiration of a leave.

Limits To Leave Without Pay

·         Employees shall not earn annual or sick leave during any leave period.

·         Leaves for individual reasons should not be granted if it causes undue hardship on departmental operations or working conditions.
